1. About these terms and acceptance

These Terms of Service apply to your use of the website inayatvastani.ae and to the marketing management services provided by Inayat Vastani Marketing Management, a business licensed in Dubai under Trader License No. 1610144, with its address at Office 305, 3rd Floor, Al Noor Business Centre, Al Maktoum Road, Al Rigga, Deira, Dubai, UAE.

By using this website you accept these terms. Where we enter into a written proposal or agreement with a client, that document applies together with these terms, and it prevails if there is a conflict.

2. Our services

We provide marketing management services, as described on the Services page. The exact scope, deliverables and timelines for each client are set out in a written proposal or agreement. Descriptions on this website are general information and are not an offer capable of acceptance.

3. No guarantee of results

We do not guarantee any particular result, including leads, enquiries, sales, search rankings, advertising performance, return on investment or revenue. Marketing results depend on many factors outside our control, such as market conditions, competition, your offer and pricing, your budget, how quickly enquiries are answered, and the rules and algorithms of third-party platforms.

We commit to carrying out the agreed work with reasonable skill and care and to reporting honestly on what it produces.

4. Client responsibilities

To allow us to provide the services, clients agree to:

• give us accurate and complete information about their business, offers and target audience;
• give us timely access to the accounts, websites and tools needed for the work;
• review and approve content, campaigns and budgets within a reasonable time;
• make sure that all materials they provide are lawful and that they have the right to use them;
• comply with the laws and advertising rules that apply to their business, products and services.

5. Fees and payment

Fees, payment terms and any billing schedule are agreed in a written proposal or agreement before work starts. Advertising spend and other third-party costs, such as platform charges and software subscriptions, are separate from our fees unless the written agreement says otherwise.

Fees are quoted and invoiced in line with applicable UAE VAT rules. We may pause work on an account where agreed payments are overdue.

6. Intellectual property

The content of this website, including its text, design and branding, belongs to us or our licensors and may not be copied or reused without our written permission.

Materials that a client provides to us remain owned by the client. Ownership and use of the work we create for a client are as set out in the written agreement.

7. Confidentiality

We treat non-public information that clients share with us as confidential, and we use it only to provide the services. This does not apply to information that is already public, that we receive lawfully from someone else, or that we are required by law or by an authority to disclose.

8. Third-party platforms

Our services involve platforms such as Meta, Google, TikTok and LinkedIn, which set their own terms and policies. These platforms may change their rules, reject or limit advertisements, or suspend accounts or campaigns at any time and for reasons we do not control. We are an independent business and are not affiliated with these platforms, and we are not responsible for their decisions.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or business opportunity arising from the use of this website or our services. Our total liability for any claim relating to a service is limited to the fees paid to us for that service.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Use of this website

You may use this website for lawful purposes only. You must not try to interfere with its operation, gain unauthorized access to it, or use it to send us unlawful or harmful material. The information on this website is general in nature and is not legal, financial or professional advice.

11. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have jurisdiction over any dispute arising from them.
